1. The short version
We collect what you type into our brief form, so we can reply to you. We do not run analytics, we do not set cookies, we do not track you across the web, and we do not sell or rent your information to anyone.
2. Who is responsible
Native ("we", "us") operates native.agency and decides how the information described here is handled. Reach us at julian@native.agency.
Native operates from Quebec, Canada and Utah, USA. If you need our registered company details in order to exercise a right described below, ask and we will provide them.
3. What we collect
What you send us. When you submit the brief form we receive:
- your name and email address, which are required
- your company name, project type, budget range and timeline, which are optional
- your description of the project, which is required
If you email us directly, we receive whatever is in that email.
Technical information. Like any website, ours is served by a host that records requests, including IP address, browser type, and the page requested. This is ordinary server logging, used to keep the site running and secure.
What we do not collect. No analytics or advertising tools run on this site. We set no cookies and store nothing in your browser. There is nothing to opt out of, which is why you were not asked to accept anything.
4. Why we use it, and on what basis
- To reply to your enquiry and scope work. Where the GDPR applies, the basis is our legitimate interest in responding to someone who contacted us, and steps taken at your request before entering a contract.
- To run and secure the site. Legitimate interest in keeping our own website available and free of abuse.
- To meet legal and accounting obligations, where one applies to us.
We do not use your information to make automated decisions about you.
5. Who else sees it
We use a small number of service providers. They process data on our instructions.
- Formspark receives and delivers our contact form submissions, so everything you put in the form passes through it.
- Vercel hosts and serves this website, so it handles the request logs described above.
- Google Fonts serves the two typefaces this site uses. Your browser requests them directly from Google, which means Google receives your IP address when you load a page. If this matters to you, the fonts can be self-hosted instead; tell us and we will move them.
We also use ordinary business email to reply to you, which means our email provider handles that correspondence.
Beyond that we share your information only if the law requires it, or to establish or defend a legal claim. We never sell it.
6. Where it goes
Our providers operate internationally, so your information may be processed outside your country, including in the United States. Where the GDPR or UK GDPR applies, transfers rely on the safeguards those providers put in place, typically Standard Contractual Clauses.
7. How long we keep it
We keep enquiries for as long as the conversation is live, and for a reasonable period afterwards in case you come back to us. Records tied to a paid engagement are kept as long as our contractual and accounting obligations require.
Concretely: an enquiry that does not become a project is deleted after 24 months, and you can ask us to delete it sooner at any time.
8. Your rights
Depending on where you live, you may have the right to ask us for a copy of the information we hold about you, to have it corrected or deleted, to restrict or object to how we use it, and to receive it in a portable form. Where we rely on consent, you can withdraw it at any time.
If you are in California, you have the right to know what personal information we collect, to have it deleted, to correct it, and not to be discriminated against for exercising those rights. We do not sell or share personal information as those terms are defined by the CCPA.
To exercise any of this, email julian@native.agency. We will respond within the time the applicable law allows. There is no charge.
If you think we have handled your information badly, please tell us first so we can put it right. You also have the right to complain to the data protection authority where you live. In Canada that is the Office of the Privacy Commissioner, in the UK the Information Commissioner's Office, and in the EEA your national authority.
9. Keeping it safe
The site is served over HTTPS and we choose providers that maintain recognised security practices. No method of transmission or storage is completely secure, so please do not send us sensitive personal information, credentials, or anything confidential through the form.
10. Children
This site is aimed at businesses and is not directed at children. We do not knowingly collect information from anyone under 16. If you believe a child has sent us information, email us and we will delete it.
11. Changes to this policy
We may update this policy. The date at the top of this page shows when it last changed. If a change materially affects how we handle your information, we will make that clear.
